The City of Franklin defines “surplus property” as property owned by the City which is of no further feasible use, or is obsolete or unusable or is in excess of required inventory, or has exceeded its useful life cycle. Although surplus property does not include lost or stolen property recovered by or turned over to the City, such property may be disposed of using the same procedures.
How does the City of Franklin dispose of its surplus property?
At the discretion of the department to which the item is assigned, surplus personal property may be traded in, with the value of the trade-in value applied as an offset to a specified purchase, but only pursuant to a sealed bid following legal notice, or may be transferred to another department that has use for the item. Otherwise, surplus personal property with any anticipated value is to be disposed of by means of electronic auction through GovDeals.com. See below for further information. By ordinance, if the proceeds of sale of surplus personal property are reasonably anticipated to exceed $4,000, then sealed bids shall be taken or a public auction held after reasonable public notice.
By ordinance, if the proceeds of sale of surplus real property are reasonably anticipated to exceed $25,000, then sealed bids shall be taken after 45 days’ public notice.
Lost or stolen property recovered by or turned over to the City may, at the discretion of the respective department, be donated to charity; otherwise, it shall be disposed of by means of electronic auction through GovDeals.com.
Disposal by Means of Electronic Auction of Surplus Personal Property or Lost or Stolen Property
The City utilizes the electronic auction service GovDeals for disposal of much of the surplus personal property owned by the City, as well as for some lost or stolen property recovered by or turned over to the City. All property is offered for sale “AS IS, WHERE IS." After removal of sold property, all sales are final. Most items offered for sale are used and may contain defects not immediately detectable. Bidders are encouraged to and may inspect for-sale property prior to bidding. Bidders must adhere to inspection dates and times indicated. City makes and Buyer receives no warranty, express or implied, including without limitation any warranty of merchantability or fitness for a particular use, with respect to any products, including any hardware or software, provided to Buyer by City pursuant to this agreement or otherwise, or any services rendered to or for Buyer pursuant to this agreement or otherwise. In no event shall City be liable to Buyer for any indirect, special, consequential, exemplary or punitive damages or lost profits, arising out of or related to this agreement or performance or breach thereof, even if City has been advised of possibility thereof. Additionally, in no event shall City be liable to Buyer for any damages resulting from or related to any failure or delay of City in performance of services under this agreement, or any failure of any product provided or sold in connection with said services or otherwise. City will use reasonable care to provide Buyer in a timely manner product as advertised. City’s liability to Buyer hereunder, if any, shall in no event exceed the total of amounts paid to City hereunder or in connection herewith by Buyer.
Payment in full is due not later than close of business five (5) City business days from date of Buyer’s Certificate or else Bidder forfeits sale of merchandise. Acceptable forms of payment are: U.S. currency, cashier’s check, certified check, money order, traveler’s checks, or a company check with a mandatory bank letter guaranteeing payment. NO PERSONAL CHECKS ACCEPTED. Checks shall be made payable to City of Franklin. Payments shall be made at location listed in Buyer’s Certificate.
All items must be removed within 10 business days from date of issuance of Buyer’s Certificate. Purchases will be released only upon receipt of payment as specified. Successful Bidders are responsible for loading and removal of any and all property awarded to them from place where property is located as indicated on website and in Buyer’s Certificate. Buyer will make all arrangements and perform all work necessary, including packing, loading and transportation of property. Under no circumstances will City assume responsibility for packing, loading or shipping. Property may only be removed during normal City hours.
